Terms of Service
Last Updated: June 13, 2026
1. Acceptance of Terms
By accessing, browsing, or placing an order on printd.art, you agree to comply with and be bound by these Terms of Service and all applicable laws. These Terms constitute a binding agreement between you and Printd Art Shops LLC, based in Provo, Utah. If you do not agree, please do not use our services.
2. Description of Service
Printd Art Shops LLC offers a curated online gallery platform showcasing fine art reproductions, historical, vintage and original artworks by local Utah artists. We provide custom printing and framing services which are always made-to-order for our customers.
3. User Accounts & Technology Partners
Creating an account is optional — you may check out as a guest or create an account to manage and track your orders. We utilize high-end technology infrastructure to secure your experience:
- Data Infrastructure (Supabase): We use Supabase for authentication, user session management, and secure database operations. You agree to provide accurate, up-to-date, and complete info during checkout.
- Payment Safety (Stripe): All billing operations and card checkouts are securely executed through Stripe. We do not store, hold, or view your raw payment credentials.
4. Custom Made-to-Order Sales
All products listed on Printd Art Shops LLC are custom-made to order according to your size, paper material, and frame configuration. As a result, production typically begins within 8–24 hours of payment confirmation, after which an order cannot be changed or cancelled. You are responsible for ensuring your shipping details and size selection are correct before submitting payment.
5. Intellectual Property
The artwork offered on printd.art is primarily derived from works believed to be in the public domain, sourced from public repositories and open access museum galleries. Public-domain source works are not owned by Printd Art Shops LLC, and we make no claim of copyright over the underlying public-domain works themselves.
We do, however, claim ownership of our own original contributions, including but not limited to: the printd.art website design, layout, code, branding, logos, and trademarks; the selection, arrangement, curation, and presentation of works in our gallery; and our specific digitally restored, edited, color-corrected, and print-ready image files. These materials are protected under United States and international law. You may not copy, scrape, reproduce, distribute, resell, or create derivative works from our website content, branding, or print-ready files without our express written consent.
If you believe any material displayed on printd.art infringes your copyright, please see our Copyright / DMCA Policy in Section 12.
6. Disclaimer of Warranties & Limitation of Liability
Our services and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Printd Art Shops LLC disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Printd Art Shops LLC and its members shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our website, products, or services. In no event shall our total aggregate liability to you for any claim exceed the amount you actually paid for the specific order giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
7. Governing Law
These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict-of-law principles. Subject to the arbitration agreement in Section 8, any permitted court action shall be brought exclusively in the state or federal courts located in Utah County, Utah.
8. Dispute Resolution — Binding Arbitration & Class-Action Waiver
Please read this section carefully — it affects your legal rights, including your right to file a lawsuit in court and to participate in a class action.
(a) Informal Resolution First. Before starting arbitration, you agree to first try to resolve the dispute informally by sending a written Notice of Dispute to printd.art.shops@gmail.com describing the issue and your requested resolution. Both parties will attempt in good faith to resolve the matter within thirty (30) days. Many disputes can be resolved this way.
(b) Binding Arbitration. If the dispute is not resolved within 30 days, any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in Utah County, Utah, or, at your election, via telephone, videoconference, or document submission. Judgment on the award may be entered in any court of competent jurisdiction.
(c) Class-Action Waiver. YOU AND PRINTD ART SHOPS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.
(d) Small-Claims Exception. Either party may instead bring an individual claim in small-claims court if the claim qualifies and remains in that court.
(e) Jury-Trial Waiver. To the extent any claim proceeds in court rather than arbitration, both parties waive any right to a jury trial.
(f) 30-Day Right to Opt Out. You may opt out of this arbitration agreement (Section 8) by emailing printd.art.shops@gmail.com within thirty (30) days of your first purchase or account creation, stating your name and intent to opt out. Opting out will not affect any other part of these Terms.
9. Eligibility & Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase. Creating an account is optional; you may also check out as a guest. You agree to provide accurate, current, and complete information and are responsible for activity under your account. We may refuse service, cancel orders, or terminate accounts at our discretion, including for suspected fraud, abuse, or violation of these Terms.
10. Pricing, Errors & Order Acceptance
All prices are listed in U.S. dollars and applicable sales tax is calculated at checkout via Stripe Tax. Despite our best efforts, products may occasionally be listed with an incorrect price, description, or image. We reserve the right to correct any errors and to refuse, cancel, or limit any order — even after an order has been submitted — including orders placed at an incorrect price. If we cancel an order that has already been charged and not yet produced, we will issue a full refund of that order.
11. Product Appearance & Color Variation
Our prints are produced from digitally restored public-domain works and made to order. Because of differences in monitors, screens, and device settings, the colors you see on your screen may not exactly match the printed product. Slight variations in color, tone, texture, cropping, matting, and frame finish are inherent to handmade, made-to-order fine-art printing and restoration, and are not considered defects.
12. Copyright / DMCA Policy
We respect intellectual-property rights and source our works in good faith from public-domain repositories. If you believe material on printd.art infringes a copyright you own, please send a written notice to our Copyright Agent including: (1) your contact information; (2) identification of the copyrighted work; (3) identification of the material claimed to be infringing and its location on our site; (4) a statement that you have a good-faith belief the use is not authorized; (5) a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and (6) your signature.
We will respond to valid notices and may remove the material in question.
13. Artist Applications (Artist Portal)
Our Artist Portal allows local artists to submit an application that includes a link to an external portfolio for our review. Submitting an application does not transfer any rights in your work to us, does not obligate us to review, accept, display, sell, or compensate you, and creates no partnership or agency relationship. Any future arrangement to feature an artist's work will be governed by a separate written agreement. Do not upload or send artwork files through the application; submit only a portfolio link and the requested contact details.
14. Indemnification
You agree to defend, indemnify, and hold harmless Printd Art Shops LLC and its members from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of our services, your violation of these Terms, your submission of any content, or your violation of any law or third-party right.
15. Promotional Codes
Discount and promotional codes are offered at our discretion, have no cash value, cannot be redeemed for cash or applied retroactively, and may not be combined unless stated. Only one code may be applied per order. We may modify, suspend, or cancel any promotion or code at any time, and codes are void where prohibited or where fraud or abuse is suspected.
16. Accessibility
Printd Art Shops LLC is committed to making printd.art accessible to all users and strives to follow recognized accessibility standards. If you encounter any difficulty using our site or need assistance placing an order, please contact us at printd.art.shops@gmail.com and we will work in good faith to help and to improve.
17. General Provisions
These Terms, together with our Privacy Policy and Refund & Shipping Policy, constitute the entire agreement between you and Printd Art Shops LLC. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms; we may assign them to a successor or affiliate. We are not liable for delays or failures caused by events beyond our reasonable control (including carrier delays, natural disasters, and supply disruptions). We may update these Terms at any time; changes are effective when posted, and your continued use constitutes acceptance.
